What the law allows in New South Wales

There is a lot of nonsense online about what an investigator may do, so here is the accurate version. Observation in a public place is generally lawful. Devices are what the law controls. In New South Wales the Surveillance Devices Act 2007 (NSW) governs listening devices, optical devices, tracking devices and data surveillance, and licensing of investigators falls under the Security Industry Act 1997 (NSW), administered by the Security Licensing and Enforcement Directorate. We would rather lose the job than gather something that cannot be used and cannot be undone.

Material gathered lawfully and documented properly is generally admissible. We keep original files unaltered and can provide a statement from the operative if a matter proceeds.

Can you put a tracking device on a vehicle?
